Why Are Bakersfield Roads So Dangerous?
Bakersfield sits where the Central Valley’s farm and freight traffic meets a fast-growing city of more than 400,000 people. In 2023, the California Office of Traffic Safety (OTS) counted 2,073 people killed or injured in crashes in Bakersfield. Among California’s 15 largest cities, Bakersfield ranked third-worst for alcohol-involved crash victims and worst for crashes involving drinking drivers under 21. The same year saw 170 pedestrians killed or injured and 238 hit-and-run crashes causing injury or death.
Crashes in and around the city tend to cluster on a few corridors:
- State Route 99. The 99 cuts straight through Bakersfield and carries heavy truck traffic hauling crops, goods, and oilfield equipment. High speeds, constant merging, and wrong-way drivers have all led to deadly crashes along this route.
- State Route 58 and the Westside Parkway. West of the 99, the 58 runs as Rosedale Highway, a busy commercial strip; to the east it heads toward Tehachapi. The Westside Parkway carries commuters across the northwest side of town.
- State Route 178. The Crosstown Freeway and 178 carry traffic toward northeast Bakersfield and the Kern River Canyon, where the road narrows and curves.
- Ming Avenue, California Avenue, and Stockdale Highway. These busy commercial corridors in southwest Bakersfield see constant turning traffic, shopping-center driveways, and red-light running.
Weather plays a role, too. Winter tule fog can drop visibility to nearly nothing on the 99 and rural roads, and chain-reaction pileups in fog are a long-standing danger in the southern Central Valley.
Who Investigates Your Crash: Bakersfield PD or the CHP?
The agency that responds depends on where the crash happened, and that determines where your report is kept.
- Bakersfield Police Department investigates collisions on city streets. The department’s records section is at 1601 Truxtun Avenue, and reports can be requested in person, by mail, or online.
- California Highway Patrol, Bakersfield Area covers State Routes 99 and 58 and the surface streets in unincorporated communities such as Rosedale, Oildale, and Lamont. Involved parties can request a CHP report using form CHP 190.
Your report can include driver statements, witness names, a diagram of the scene, and the officer’s view of who caused the crash. When you hire Johnson Attorneys Group, we request it for you and check it against photos, video, and medical records.

What Is the Statute of Limitations for Personal Injury Claims in California?
A statute of limitations is the legal deadline to file a lawsuit. These deadlines are set by California state law, so they’re the same in Bakersfield as anywhere else in the state. Miss one, and the court can dismiss your case no matter how strong it is.
- Most personal injury claims: two years. Under California Code of Civil Procedure section 335.1, you generally have two years from the date of the injury to file a lawsuit. This covers most car, truck, and motorcycle accidents, slip and falls, and dog bites.
- Wrongful death: two years. Families generally have two years from the date of their loved one’s death to file a wrongful death lawsuit.
- Claims against a government agency: six months. If a city, county, or state agency is responsible, such as a crash with a government vehicle or a dangerous public road, you generally must file a written claim with that agency within six months (Government Code section 911.2). If the agency rejects your claim, you usually have six months from the date the rejection notice is mailed or delivered to file a lawsuit.
- Medical malpractice: one year from discovery, three years at most. A claim against a health care provider generally must be filed within one year after you discover the injury, or three years after the injury, whichever comes first (Code of Civil Procedure section 340.5).
- Injured children. For most claims, the two-year deadline doesn’t begin until a child turns 18. This pause does not apply to the six-month deadline for claims against government agencies.
- Vehicle and property damage: three years. Claims for damage to your car or other property generally have a three-year deadline (Code of Civil Procedure section 338).
Exceptions can shorten or extend these deadlines, and the rules for government claims are especially strict. The safest move is to talk with a lawyer as soon as you can, while evidence is still fresh.
What Compensation Can You Recover After an Accident in Bakersfield?
Every case is different, but compensation in a California personal injury claim can include:
- Medical expenses, including emergency care, surgery, therapy, and future treatment
- Lost wages and reduced future earning capacity
- Pain and suffering and emotional distress
- Property damage, such as vehicle repair or replacement
- Wrongful death damages for families, including funeral costs and loss of support and companionship
Since January 1, 2025, California drivers must carry at least $30,000 per person and $60,000 per accident in bodily injury liability coverage. Serious injuries often cost more than that, so we also look at uninsured/underinsured motorist coverage, employer liability in work-vehicle and trucking crashes, and any other responsible parties.
Where Are Bakersfield Personal Injury Cases Filed?
Most injury claims settle without a lawsuit. If yours doesn’t, your case would be filed with Kern County Superior Court. Bakersfield cases fall under the court’s Metropolitan Division, which handles civil matters at its courthouses on Truxtun Avenue in downtown Bakersfield.
- Free consultation. We listen, review your documents, and explain your options.
- Investigation. We gather the police or CHP report, photos, video, witness statements, and medical records.
- Demand and negotiation. Once we understand the full extent of your injuries, we demand fair compensation from the insurer and negotiate.
- Lawsuit and trial, if needed. If the insurer won’t pay what your case is worth, we file suit, exchange evidence, attend mediation, and prepare for trial.
What Should You Do After an Accident in Bakersfield?
- Get medical care. Call 911 if anyone is hurt, and see a doctor even if you feel okay. Some injuries take days to appear.
- Report the crash. Make sure Bakersfield PD or the CHP is notified, and write down the report number.
- Document everything. Take photos of the vehicles, the scene, road and weather conditions, and your injuries.
- Get information. Collect the other driver’s name, license, and insurance details, and contact information for any witnesses.
- Look for video. Businesses along Ming, California, and Rosedale often have cameras, but footage gets recorded over quickly.
- Be careful with insurers. Don’t give a recorded statement to the other driver’s insurance company before you talk with a lawyer.
- Track your losses. Keep medical bills, receipts, and a record of missed work.
Which Bakersfield Neighborhoods Do We Serve?
We help injury victims throughout Bakersfield, including Campus Park, West Park Community, East Bakersfield, Kern City, Oleander-Sunset, Seven Oaks, City in the Hills, Haggin Oaks, and Rio Bravo. We also represent clients in nearby Kern County communities, including Rosedale, Oildale, and Lamont.
Frequently Asked Questions About Bakersfield Personal Injury Claims
How long do I have to file a personal injury claim in Bakersfield?
For most injury claims, California law gives you two years from the date of the injury to file a lawsuit. If a government agency is involved, you generally have only six months to file a claim with that agency first. Because exceptions apply, it’s best to speak with a lawyer as soon as possible.
How do I get a copy of my Bakersfield accident report?
If Bakersfield police responded, you can request your report from the department’s records section at 1601 Truxtun Avenue, by mail, or online. If the crash happened on Highway 99, the 58, or in an unincorporated area like Rosedale or Oildale, the CHP likely handled it, and you can request the report with form CHP 190. If you hire us, we’ll get it for you.
What if the driver who hit me fled the scene?
You may still have options. Your own uninsured motorist coverage can often pay for injuries caused by a hit-and-run driver, but California policies generally require that the other vehicle made physical contact with you or your vehicle. Report the crash to police right away, since insurers may require a prompt report, and call us to review your coverage.
Can I still recover compensation if I was partly at fault?
Yes. California follows pure comparative fault, so you can recover damages even if you share some of the blame. Your compensation is reduced by your percentage of fault. If you were 25 percent at fault, for example, you could still recover 75 percent of your damages.
How much does it cost to hire a Bakersfield personal injury lawyer at Johnson Attorneys Group?
Your consultation is free, and we work on a contingency fee basis. That means you don’t pay attorney fees unless we win your case. We’ll explain exactly how fees work before you sign anything.
